By adding Firsty to a server or using any of its commands, you agree to these Terms. ## Overview These Terms of Service ("Terms") are an agreement between you and **colddev** ("we", "us", "our"), the operator of **Firsty** ("the Bot"), a bot for the Discord platform. The Terms cover every way you interact with the Bot: inviting it to a server, configuring it, running its commands, or being a member of a server where it is active. If you do not agree with these Terms, do not use the Bot and remove it from any server you manage. ## Discord's terms come first Firsty runs entirely on Discord. Your use of the Bot is also subject to Discord's own rules, and nothing in these Terms overrides them: The rules for using Discord itself. What is and isn't allowed on the platform. The terms we follow as a bot developer. How bots must treat users and their data. We operate Firsty in line with these documents. If anything in these Terms conflicts with Discord's rules, Discord's rules apply. ## Eligibility To use the Bot, you must: * Meet the minimum age required by Discord in your country, and have a valid Discord account in good standing. * If you add the Bot to a server, have the permission to do so (the **Manage Server** permission) and the authority to accept these Terms on behalf of that server. ## Acceptable use You agree to use the Bot only for its intended purpose and in a way that respects other people. You must **not**: * Use the Bot to harass, threaten, spam, raid, or send unsolicited messages to anyone. * Use the Bot to share or promote content that is illegal or that breaks Discord's Terms or Community Guidelines. * Abuse commands, deliberately trigger rate limits, or send automated requests to the Bot (including through self-bots or user-account automation). * Exploit bugs or vulnerabilities, or try to disrupt, overload, or gain unauthorized access to the Bot, its infrastructure, or its data. * Reverse-engineer, decompile, copy, or resell the Bot or any part of it. * Impersonate the Bot, its developer, or its support team. * Use the Bot in a way that could harm other users, servers, or the Bot itself. Found a bug or a security issue? Report it to us privately instead of exploiting it. We appreciate responsible disclosure. ## Responsibilities of server administrators If you add Firsty to a server, you are responsible for how it is set up there. This includes: * Granting the Bot only the permissions it needs for the features you use. * Configuring its features in a way that complies with Discord's rules and with applicable law. * Letting your members know that the Bot is active and, where relevant, pointing them to these Terms and our [Privacy Policy](/privacy). ## Availability and changes to the Bot Firsty is provided free of charge and on an "as is" and "as available" basis. We work to keep it online and reliable, but we cannot guarantee uninterrupted service. We may add, change, pause, or remove features, or discontinue the Bot entirely, at any time and without prior notice. ## Enforcement To protect our users and the Bot, we may, at our discretion and without prior notice: * Restrict or block access to the Bot for any user or server (blacklisting). * Remove the Bot from a server. * Report conduct to Discord when it breaks Discord's rules. We typically take action when these Terms are violated, when required by Discord or by law, or when it is necessary to prevent harm. If you believe an action was taken by mistake, you can contact us through the channels listed below. ## Intellectual property The Bot, including its name, logo, design, and documentation, belongs to colddev and is protected by intellectual property laws. Using the Bot does not give you any ownership rights over it. Content you or your members provide (for example, text you enter into a command or your server's configuration) remains yours. You grant us a limited, non-exclusive license to process that content only as needed to operate the Bot's features for you. ## Third-party services The Bot depends on Discord and on the infrastructure providers that host it. We are not responsible for the availability, content, or practices of these third parties, including any outages or changes on Discord's side that affect the Bot. ## Disclaimer To the maximum extent permitted by law, the Bot is provided without warranties of any kind, whether express or implied, including warranties of fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Bot will be error-free, secure, or always available. ## Limitation of liability To the maximum extent permitted by law, colddev is not liable for any indirect, incidental, or consequential damages, or for any loss of data, server configuration, or content, arising from your use of, or inability to use, the Bot. Nothing in these Terms limits liability that cannot be limited under applicable law. ## Termination You can stop using the Bot at any time by removing it from your server or no longer using its commands. We may suspend or end your access at any time, as described in [Enforcement](#enforcement). What happens to your data afterwards is explained in our [Privacy Policy](/privacy#data-retention). ## Changes to these Terms We may update these Terms from time to time. When we do, we will change the **Last updated** date at the top of this page and, for significant changes, may also announce them in our support server. Continuing to use the Bot after an update means you accept the revised Terms. ## Governing law These Terms are governed by the laws of Romania. Any dispute will be settled by the competent courts of Romania, without affecting any mandatory rights you have as a consumer under the laws of the country where you live. ## Contact Questions about these Terms?
